FÜR DIE SOFTWAREPROGRAMME VON CANON ODER DESSEN LIZENZGEBERN

WICHTIG

Dies ist eine rechtlich bindende Vereinbarung ("Vereinbarung") zwischen Ihnen 
und Canon Inc. ("Canon") über die Verwendung der Softwareprogramme von Canon 
oder dessen Lizenzgebern, die in diesem Canon Produkt, dem "Canon Common 
Printer Driver for Linux v1.80" (dem "Produkt"), enthalten sind. Die 
betreffenden Softwareprogramme sind in Verzeichnis 1 der Anlage zu dieser 
Vereinbarung aufgeführt. Derartige Softwareprogramme von Canon oder dessen 
Lizenzgebern werden nachstehend als die "Software" bezeichnet.

LESEN SIE DIESE VEREINBARUNG SORGFÄLTIG DURCH. VOR DER VERWENDUNG DER SOFTWARE 
MÜSSEN SIE SICH MIT DEN BESTIMMUNGEN UND BESCHRÄNKUNGEN DIESER VEREINBARUNG 
VERTRAUT MACHEN.

DURCH DIE VERWENDUNG DER SOFTWARE GEMÄSS ABSATZ 1 ERKLÄREN SIE SICH 
EINVERSTANDEN, AN DIE BESTIMMUNGEN UND BEDINGUNGEN DIESER VEREINBARUNG 
GEBUNDEN ZU SEIN. FALLS SIE MIT DEN BEDINGUNGEN UND BESTIMMUNGEN DIESER 
LIZENZVEREINBARUNG NICHT EINVERSTANDEN SIND, DÜRFEN SIE DIE SOFTWARE NICHT 
VERWENDEN. GEBEN SIE SIE IN DIESEM FALL UMGEHEND AN DEN HÄNDLER ZURÜCK.


1. LIZENZÜBERTRAGUNG

Canon gewährt Ihnen eine persönliche, beschränkte und nicht-exklusive Lizenz 
für die Verwendung der Software ausschließlich mit dem Produkt (wobei 
"Verwendung" im Rahmen dieser Lizenzvereinbarung das Speichern, Laden, 
Installieren, Ausführen und Anzeigen der Software sowie den Zugriff darauf 
umfasst) durch Sie selbst oder in Ihrem Auftrag, das Kopieren durch Sie selbst 
oder in Ihrem Auftrag sowie das Verteilen der Software und das Verwenden sowie 
Kopieren durch Dritte mit Ihrer Genehmigung. Sie dürfen die Software nur für 
den eigenen Gebrauch verändern und zur Fehlerbehebung im Rahmen solcher 
Veränderungen zurückentwickeln. Sie dürfen die Software gemäß den Bestimmungen 
und Bedingungen dieser Lizenzvereinbarung an Dritte verteilen. 

2. BESCHRÄNKUNGEN

Sie dürfen die Software nicht zu anderen als ausdrücklich in dieser 
Vereinbarung gewährten und gestatteten Zwecken verwenden, und Sie dürfen die 
Software an keinen Dritten abtreten, unterlizenzieren, verkaufen, vermieten, 
leasen, verleihen, übereignen oder übertragen.

3. URHEBERRECHSHINWEIS

Sie dürfen einen Urheberrechtshinweis von Canon und seinen Lizenzgebern, der 
in der Software einschließlich aller Kopien enthalten ist, nicht verändern, 
entfernen oder löschen.

4. EIGENTUMSRECHTE

Canon und seine Lizenzgeber behalten sich bezüglich der Software das alleinige 
Urheberrecht, Eigentumsrecht sowie das ausschließliche Nutzungsrecht an 
geistigem Eigentum vor. Canon überträgt Ihnen, ausdrücklich oder 
stillschweigend, keine weiteren Lizenz- oder Nutzungsrechte an geistigem 
Eigentum von Canon oder seinen Lizenzgebern, die über die ausdrücklichen 
Bestimmungen dieser Vereinbarung hinausgehen.

5. EXPORTBESCHRÄNKUNGEN

Mit der Annahme dieser Vereinbarung erklären Sie sich damit einverstanden, 
alle Exportgesetze und –beschränkungen des entsprechenden Landes einzuhalten 
und die Software nicht unter Verletzung dieser Gesetze, Beschränkungen oder 
Regelungen, weder direkt noch indirekt, zu exportieren oder zu reexportieren.

6. GEWÄHRLEISTUNGSAUSSCHLUSS UND ABLEHNUNG VON SCHADENERSATZ

DIE SOFTWARE WIRD AUF DER GRUNDLAGE "WIE GELIEFERT" BEREITGESTELLT, OHNE 
GARANTIEN JEGLICHER ART, GLEICH OB AUSDRÜCKLICH ODER IMPLIZIERT UND 
EINSCHLIESSLICH ABER NICHT BESCHRÄNKT AUF GARANTIEN BEZÜGLICH DER 
HANDELSÜBLICHKEIT UND DER EIGNUNG FÜR EINEN BESTIMMTEN ZWECK. DAS GESAMTE 
RISIKO BEZÜGLICH DER QUALITÄT, FUNKTION UND LEISTUNG DER SOFTWARE WIRD VON 
IHNEN GETRAGEN. SOLLTE SICH DIE SOFTWARE ALS FEHLERHAFT ERWEISEN, GEHEN 
SÄMTLICHE REPARATUR- UND FEHLERBESEITIGUNGSARBEITEN SOWIE DEREN KOSTEN ZU 
IHREN LASTEN.

UNTER KEINEN UMSTÄNDEN SIND CANON, SEINE TOCHTERGESELLSCHAFTEN ODER 
ZWEIGSTELLEN, SEINE DISTRIBUTOREN, FACHHÄNDLER ODER LIZENZGEBER 
SCHADENERSATZPFLICHTIG FÜR SCHÄDEN JEGLICHER ART (EINSCHLIESSLICH ABER NICHT 
BESCHRÄNKT AUF ERTRAGSEINBUSSEN, VERLOREN GEGANGENE GESCHÄFTSINFORMATIONEN, 
BETRIEBSUNTERBRECHUNG ODER SONSTIGE KOMPENSATORISCHE, ZUFÄLLIGE ODER 
FOLGESCHÄDEN), DIE AUS DER VERWENDUNG ODER UNMÖGLICHKEIT DER VERWENDUNG DER 
SOFTWARE ENTSTEHEN, SELBST WENN CANON, SEINE TOCHTERGESELLSCHAFTEN ODER 
ZWEIGSTELLEN, SEINE DISTRIBUTOREN, FACHHÄNDLER ODER LIZENZGEBER VON DER 
MÖGLICHKEIT SOLCHER SCHÄDEN IN KENNTNIS GESETZT WURDEN.

SIE ENTBINDEN HIERMIT CANON IM VOLLEN GESETZLICHEN UMFANG, SEINE 
TOCHTERGESELLSCHAFTEN UND ZWEIGSTELLEN, SEINE DISTRIBUTOREN, FACHHÄNDLER ODER 
LIZENZGEBER VON DER HAFTUNG, DIE SICH AUS ANSPRÜCHEN BEZÜGLICH DER SOFTWARE 
UND DEREN VERWENDUNG ERGIBT.

7. LAUFZEIT

Diese Vereinbarung tritt mit Ihrer Annahme derselben durch die Verwendung der 
Software in Kraft und ist bis zu ihrer Beendigung gültig. Sie können diese 
Vereinbarung durch das Vernichten der Software beenden. 

Canon kann die Vereinbarung beenden, wenn Sie gegen eine ihrer Bestimmungen 
verstoßen. Nach einer solchen Beendigung der Vereinbarung ist es Canon 
vorbehalten, seine Rechte einzuklagen; außerdem müssen Sie in diesem Fall 
unverzüglich die Software vernichten. 

Ungeachtet des Vorstehenden bleiben die Absätze 4 und 6 bis 10 auch bei einer 
Beendigung dieser Vereinbarung rechtsgültig.

8. U.S. GOVERNMENT RESTRICTED RIGHTS NOTICE

The Software is "commercial items," as that term is defined at 48 C.F.R. 2.101 
(October 1995), consisting of "commercial computer software" as such terms are 
used in 48 C.F.R. 12.212 (September 1995). Consistent with 48 C.F.R. 12.212 
and 48 C.F.R. 227.7202-1 through 227.7202-4 (June 1995), all U.S. Government 
End Users shall acquire the Software with only those rights set forth herein. 
Manufacturer is Canon Inc./30-2, Shimomaruko 3-chome, Ohta-ku, Tokyo 146-8501, 
Japan.

9. SALVATORISCHE KLAUSEL

In dem Fall, dass eine hier enthaltene Bestimmung von einem zuständigen 
Gericht für ungesetzlich erklärt oder befunden wurde, wird diese Bestimmung in 
Anbetracht der Rechtsprechung dieses Gerichts nichtig. Alle anderen hier 
enthaltenen Bestimmungen behalten ihre volle Wirkung.

10. EINVERSTÄNDNIS

SIE ERKENNEN AN, DASS DIESE VEREINBARUNG DIE VOLLSTÄNDIGE UND ALLEINIGE

GLEICH OB MÜNDLICH ODER SCHRIFTLICH, SOWIE JEGLICHE ANDERE KOMMUNIKATION
